80 Percent Arms Formally Included in the Lawsuit Against the ATF now

This Tuesday, District Judge Reed O’Connor formally ordered the Court to add 80 Percent Arms in the VanDerStok case against the ATF as an additional plaintiff. You might be seeing the company name BlackHawk Manufacturing Group Inc., that’s still us. It’s just our legal name and no, we do not make the infamous Serpa holster.

Jokes aside, we have dealt a major blow to the ATF! When we requested the court allow us to legally intervene, the ATF opposed it saying we didn’t submit the request ‘timely’ enough and that the case with Tactical Machining adequately represented our interests. Obviously, the Court disagreed - the initial and even subsequently expanded preliminary injunction for this case’s plaintiffs in VanDerStok v. Garland only covered the plaintiffs and Tactical Machining’s customers, no one else in the country.

Without being included in this case and securing a preliminary injunction for ourselves, we would be at a significant disadvantage in being affected by the ATF’s new “final rule on redefining frames or receivers while our customers also suffer in waiting for their orders on hold. We have tried to be as informative as possible in this process but it’s understandable that many of our customers have had legal concerns during this time.

That is why yesterday, on October 20th, 2022, 80 Percent Arms filed a motion for a preliminary injunction against the ATF’s unconstitutional rule (2021R-05F). We look forward to providing our loyal customers with great news in the near future.

Over 100 Dems demand ATF get aggressive on 80 Percent lowers

In response to the Northern District Court of Texas allowing us to legally be included in the VanDerStok case, 135 Democrats have written a letter together to the ATF, demanding that they get aggressive on 80 percent lower receivers. Cry all they want, these anti-gunners don't understand what constitutional limits they themselves had set for the ATF’s jurisdiction in what products they can regulate in our industry in the first place. The gun grabbers are making noise because: 1. It’s Midterm Election season - best time to be virtue signaling and showboating (though this is pretty late as the vote is less than a month away)2. They know we’re gaining traction!

Fact of the matter is that things are really looking up for us in the 80 percent sect of the gun industry. Just last week a federal judge ruled that it was legal to not have serial numbers on a pistol frame. To go even a step further, a federal judge from West Virginia ruled that a federal ban on possessing a gun with its serial number removed is unconstitutional!

In September, the ATF issued an open letter that opened the door for all manufacturers to sell 80 lowers so long as they didn’t include the jigs, manuals, or instructions on how to complete 80 percents into 100% firearms.

Well, Canadians have had enough and as many as five provinces have banded together in a motion to oppose the national gun confiscation policy that PM Justin Trudeau has unilaterally imposed on the Canadians through his own position’s power without debate or deliberation from his own country’s legislators.

Minister of Justice and Solicitor General for Alberta Tyler Shandro said himself, “Make no mistake, the federal firearms confiscation program will cost us billions and will not improve public safety. Alberta’s government is not legally obligated to provide resources and will not do so.”

The provinces that have had officials speak out and pass motions over liberal oppositions currently include Alberta, Saskatchewan, Manitoba, New Brunswick, and Yukon Territory. Git’r done Canucks, eh!

Unless you want the most anti-gun Congress in history to change and make laws affecting your 2A rights and more, we highly suggest you do your research and participate in this critical event. It’s not just about civic duty, it’s your responsibility as an American to show up. Tell all your friends the same and don’t stop until the results are out!
